What is a Special Guardianship Orders, and how does it work?

What is a Special Guardianship Order?

A Special Guardianship Order is a legal arrangement that grants you, as a guardian, the authority to make crucial decisions about a child’s upbringing and welfare. It’s an ideal solution when a child cannot live with their birth parents but should maintain a relationship with them.

Are You Eligible to Apply?

To apply for an SGO, you should:

  • Be at least 18 years old
  • Not be the child’s parent (except in exceptional circumstances)
  • Be able to provide a stable and secure home
  • Understand and commit to meeting the child’s needs
  • Be capable of managing the responsibilities of a special guardian

The Application Process: How We Can Help

  1. Initial Consultation: We will assess your situation and advise on the best course of action.
  • Mediation Support: If required, we’ll represent your interests during mediation with local authorities or other parties in an attempt to reach an agreement on the SGO
  • Pre-application Assessment:  You are required to contact your local authority’s children service department requesting a pre-application assessment. The purpose of this assessment is to enable the local authority to evaluate your suitability to be a special guardian and the child’s needs. It is therefore important to contact the Local Authority in writing when requesting the SGO assessment be done. This check will include a background check, financial assessment, and reference checks.  This request to the Local Authority is known as letter of intent, and Local Authority should complete the report within 12 weeks of receipt of your letter.
  • Obtaining Consent: We’ll assist in securing written consent from the child’s parents if they agree with your SGO application. If they don’t consent, we’ll prepare a strong case for the court’s consideration, focusing on the child’s best interests and the Local Authority’s recommendations.
  • Application Preparation: Our team will help you complete all necessary application forms and gather supporting documents. We’ll ensure that all details about the child, your relationship, and reasons for seeking an SGO are clearly presented.
  • Court Submission: We’ll submit your completed application to the appropriate family court and handle any required fee payments. Our team will keep you informed as the court reviews your application and schedules hearings.
  • SGO Hearing Representation: If your application proceeds to a hearing, our experienced solicitors or instructed barristers will represent you in court. We’ll present your case compellingly and address any concerns raised by interested parties.
  • Post-Order Support: Upon successful granting of the SGO, we’ll review the order with you, explaining your rights and responsibilities as a special guardian.
