Clear legal advice when a Will, inheritance or estate administration is disputed.

Our contentious probate solicitors help clients in Edmonton, Enfield and across North London understand their position and take proportionate action. Early advice can preserve evidence, protect estate assets and create more options for resolving a dispute.

Disputes about Wills and estates

A dispute may concern whether a Will is valid, how an executor is handling the estate, who should inherit, or whether reasonable financial provision has been made.

How we can help

  • Challenges involving lack of testamentary capacity
  • Claims involving undue influence, fraud or forgery
  • Concerns that a Will was not properly signed or witnessed
  • Disputes about the meaning of a Will
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • Executor and administrator disputes
  • Applications to remove or replace a personal representative
  • Beneficial-interest and estate-property disputes
  • Probate caveats and warnings

Challenging the validity of a Will

A Will may be challenged on specific legal grounds. Disagreeing with its terms is not enough by itself. We assess the circumstances, available evidence and likely costs before recommending the next step.

Claims for reasonable financial provision

Certain spouses, partners, children, dependants and others may be able to claim reasonable financial provision from an estate. Strict time limits can apply, so prompt advice is important.

Problems with executors

Executors must administer the estate properly and in the interests of the beneficiaries. We advise beneficiaries and personal representatives where there are delays, missing information, conflicts of interest or concerns about estate assets.

Resolving a probate dispute

Many disputes can be resolved through correspondence, negotiation or mediation. Where court proceedings are necessary, we will explain the risks, costs and available options clearly.
