What is a divorce Certificate ?

This is the final piece of paper that you receive confirming that your marriage is officially at an end.

In this article, we will touch on where you can get the certificate and how to go about replacing a divorce certificate in case you cannot find the copy that had been provided to you.

‘Divorce certificate’ simply means ‘decree absolute’. This decree absolute is the legal document to show that you are no longer married and are free to remarry.

In addition to the above, it is worth noting that the decree nisi is not a final divorce certificate, but an essential part of the divorce process.

Divorce certificate

To get a divorce certificate, one spouse will have to start the divorce proceeding. This means the person bringing the proceedings is known as the ‘petitioner’ and the other spouse will be known as the respondent in the proceedings.

Once you are in receipt of the decree nisi, you will need to wait at least 6 weeks and 1 day before you can apply for the decree absolute.

When it comes to divorce matters, it is highly recommended that you seek independent legal advice from a divorce solicitor, such as Adel Jibs Solicitors before beginning the divorce process
